Doris Morales Mart\u00ednez ist eine der angesehensten Juristinnen Uruguays und derzeit Pr\u00e4sidentin des Obersten Gerichtshofs von Uruguay. Im Laufe ihrer langen Laufbahn im uruguayischen Justizsystem hat sie verschiedene richterliche Funktionen ausge\u00fcbt und sich umfassende Erfahrung in der Rechtsprechung und in der institutionellen Entwicklung der Justiz erworben.<\/p>

Sie studierte Rechtswissenschaften an der Universidad de la Rep\u00fablica in Uruguay und begann anschlie\u00dfend eine Karriere innerhalb der Justiz, in deren Verlauf sie unter anderem als Richterin und sp\u00e4ter als Mitglied eines Berufungsgerichts t\u00e4tig war. Ihre berufliche Laufbahn f\u00fchrte schlie\u00dflich in den Obersten Gerichtshof, das h\u00f6chste Gericht des Landes.<\/p>

In ihrer richterlichen T\u00e4tigkeit hat sie sich insbesondere f\u00fcr die St\u00e4rkung der richterlichen Unabh\u00e4ngigkeit, die Wahrung der Verfassung sowie den Schutz der Grundrechte eingesetzt und damit einen wichtigen Beitrag zur Festigung des Rechtsstaats und der Justizinstitutionen in Uruguay geleistet.<\/p><\/div><\/div>\n <\/section>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t

Direktor des Rechtsstaatsprogramms Lateinamerika der Konrad-Adenauer-Stiftung, mit Sitz in Bogot\u00e1\/Kolumbien. Von 2017 bis 2021 arbeitete er als Direktor des Rechtsstaatsprogramms f\u00fcr S\u00fcdosteuropa unserer Stiftung (mit Sitz in Bukarest\/Rum\u00e4nien).<\/p>

Er ist spezialisiert auf europ\u00e4isches Recht und V\u00f6lkerrecht, \u00dcbergangsjustiz, multilaterale Entwicklungspolitik, die Organisation f\u00fcr Sicherheit und Zusammenarbeit in Europa (OSZE) und alternative Konfliktl\u00f6sung. Er verf\u00fcgt \u00fcber umfangreiche regionale Erfahrungen in Ost- und S\u00fcdosteuropa sowie im postsowjetischen Raum.<\/p>

Seit 2017 ist er in verschiedenen Funktionen f\u00fcr die Konrad-Adenauer-Stiftung t\u00e4tig. Zuvor war er vom Ausw\u00e4rtigen Amt an die OSZE-Mission in der Republik Moldau entsandt worden. Der Oberste Gerichtshof der argentinischen Nation, der seit 1863 besteht, ist das h\u00f6chste Gericht der argentinischen Republik und setzt sich aus f\u00fcnf Ministern zusammen. Er ist das h\u00f6chste Organ innerhalb einer der drei Staatsgewalten und hat die Aufgabe, den Vorrang der Verfassung zu gew\u00e4hrleisten, ihre letzte Auslegungsinstanz zu sein, die darin verankerten Rechte und Garantien zu sch\u00fctzen und an der Regierung der Republik mitzuwirken. Da Argentinien ein f\u00f6deraler Staat ist, gibt es im Land nationale Gerichte und Gerichte auf Provinzebene (Art. 5 der nationalen Verfassung). Sie sind f\u00fcr die nationale Justiz zust\u00e4ndig, und der Oberste Gerichtshof hat als letzte Instanz die Aufgabe, Konflikte zwischen B\u00fcrgern oder zwischen B\u00fcrgern und dem Staat zu l\u00f6sen, das gesamte Rechtssystem auszulegen und zu systematisieren und die Verfassungsm\u00e4\u00dfigkeit der staatlichen Vorschriften und Handlungen zu kontrollieren.<\/p>

Das Plurinationale Verfassungstribunal von Bolivien ist ein unabh\u00e4ngiges plurinationales Rechtsprechungsorgan im Dienste der Gesellschaft, das eine effiziente und transparente Verfassungsgerichtsbarkeit gew\u00e4hrleistet und den Plurinationalen Verfassungsstaat des autonomen Rechts konsolidiert. Es wurde im Rahmen der 1994 durchgef\u00fchrten Verfassungsreform gegr\u00fcndet und soll den Vorrang der Verfassung sicherstellen, indem er eine plurale Kontrolle der Verfassungsm\u00e4\u00dfigkeit aus\u00fcbt, um die Achtung und Durchsetzung der verfassungsm\u00e4\u00dfigen Rechte und Garantien im Rahmen einer pluralen und dekolonisierenden Justiz im Einklang mit den Verfassungsgrunds\u00e4tzen und -werten zu gew\u00e4hrleisten.<\/p>

Der 1808 gegr\u00fcndete Oberste Bundesgerichtshof Brasiliens ist das oberste Organ der brasilianischen Justiz. Er setzt sich aus elf Ministern zusammen. Zu den Hauptaufgaben des Gerichtshofs geh\u00f6rt es, \u00fcber die unmittelbare Klage auf Verfassungswidrigkeit eines Bundes- oder Landesgesetzes oder einer Rechtsvorschrift, \u00fcber die Feststellungsklage auf Verfassungsm\u00e4\u00dfigkeit eines Bundesgesetzes oder einer Rechtsvorschrift, \u00fcber die Behauptung der Nichteinhaltung eines Grundgebots, das sich aus der Verfassung selbst ergibt, und \u00fcber die von einem ausl\u00e4ndischen Staat beantragte Auslieferung zu entscheiden.<\/p>

Das chilenische Verfassungsgericht ist f\u00fcr die pr\u00e4ventive und nachtr\u00e4gliche Kontrolle von Rechtsnormen, einschlie\u00dflich Dekreten mit Gesetzeskraft, zust\u00e4ndig; im letzteren Fall durch Unanwendbarkeits- oder Verfassungswidrigkeitsklagen. Dieses Gericht kontrolliert auch pr\u00e4ventiv und fakultativ Verfassungsreformprojekte und internationale Vertr\u00e4ge, die dem Kongress zur Genehmigung vorgelegt werden. Ebenso \u00fcbt sie eine pr\u00e4ventive und nachtr\u00e4gliche Kontrolle der Vorschriften \u00fcber die Regelungsbefugnisse (Dekrete und Beschl\u00fcsse) aus. Schlie\u00dflich werden Fragen der Verfassungsm\u00e4\u00dfigkeit von Beschl\u00fcssen der Obersten Gerichtsh\u00f6fe (Oberster Gerichtshof und Berufungsgerichte) und des Wahlpr\u00fcfungsgerichts gekl\u00e4rt. Es wurde 1970 gegr\u00fcndet und besteht aus zehn Ministern.\u00a0<\/p>

Das kolumbianische Verfassungsgericht ist ein Organ der Judikative der Staatsgewalt. Es wurde mit der Verabschiedung der Verfassung von 1991 mit dem Ziel geschaffen, die Integrit\u00e4t und den Vorrang der politischen Verfassung zu gew\u00e4hrleisten. Das Gericht setzt sich aus neun Richtern zusammen, die vom Senat der Republik auf der Grundlage von Vorschlagslisten des Pr\u00e4sidenten der Republik, des Obersten Gerichtshofs und des Staatsrats f\u00fcr einen Zeitraum von acht Jahren ernannt werden.\u00a0<\/p>

Das Verfassungsgericht der Dominikanischen Republik wurde am 26. Januar 2010 durch die Verfassung gegr\u00fcndet. Seine Aufgabe ist es, den Vorrang der Verfassung, die Verteidigung der verfassungsm\u00e4\u00dfigen Ordnung und den Schutz der Grundrechte zu gew\u00e4hrleisten. Das Verfassungsgericht wurde von der Verfassung als oberstes Organ der Auslegung und Kontrolle der Verfassungsm\u00e4\u00dfigkeit konzipiert. Um die von der Verfassung und dem Gesetz 137-11 \u00fcber das Verfassungsgericht und die verfassungsrechtlichen Verfahren ausdr\u00fccklich \u00fcbertragenen Befugnisse zu erf\u00fcllen, sind die Entscheidungen des Verfassungsgerichts endg\u00fcltig und unwiderruflich und stellen verbindliche Pr\u00e4zedenzf\u00e4lle f\u00fcr die \u00f6ffentlichen Beh\u00f6rden und alle staatlichen Einrichtungen dar. Der Verfassungsgerichtshof ist von den anderen \u00f6ffentlichen Gewalten und Organen des Staates unabh\u00e4ngig und verf\u00fcgt \u00fcber Verwaltungs- und Haushaltsautonomie. Der Interamerikanische Gerichtshof f\u00fcr Menschenrechte (IACHR) ist neben dem Europ\u00e4ischen Gerichtshof f\u00fcr Menschenrechte und dem Afrikanischen Gerichtshof f\u00fcr Menschenrechte und Rechte der V\u00f6lker einer der drei regionalen Gerichte f\u00fcr den Schutz der Menschenrechte. Es handelt sich um ein 1979 gegr\u00fcndetes, autonomes Rechtsprechungsorgan, dessen Aufgabe die Anwendung und Auslegung des Amerikanischen \u00dcbereinkommens ist. Das IACHR hat eine streitentscheidende Funktion, die die Beilegung von Streitf\u00e4llen und den Mechanismus zur \u00dcberwachung von Urteilen umfasst, eine beratende Funktion und die Funktion, vorl\u00e4ufige Ma\u00dfnahmen zu erlassen.
